Considering Marriage? |

Many Minnesota same-sex couples may be considering going to Canada or elsewhere to marry, and ongoing litigation may result in further opportunities to marry. Whether to marry is a complex decision, with many legal, and deeply personal, implications. It should not be made lightly, nor should a couple marry solely for the purpose of filing a lawsuit seeking recognition of the marriage. Couples should also bear in mind that Minnesota courts are likely powerless to grant a divorce to a married same-sex couple, or to terminate a civil union/domestic partnership from another state. Additionally, couples should not rely on out-of-state same-sex marriages to offer the legal protections of a legal Minnesota marriage, but should supplement their marriage license with other, existing legal arrangements to protect their relationship.
