Many Minnesota same-sex couples may be considering going to Canada or
elsewhere to marry, and ongoing litigation may result in further
opportunities to marry.
Whether to marry is a complex decision, with many legal, and deeply
personal, implications. It should not be made lightly, nor should a
couple marry solely for the purpose of filing a lawsuit seeking
recognition of the marriage. Couples should also bear in mind that
Minnesota courts are likely powerless to grant a divorce to a married
same-sex couple, or to terminate a civil union/domestic partnership from
another state. Additionally, couples should not rely on out-of-state
same-sex marriages to offer the legal protections of a legal Minnesota
marriage, but should supplement their marriage license with other,
existing legal arrangements to protect
their relationship.
The media turns to OutFront Minnesota on a regular basis for
information on what is happening in Minnesota's GLBT families. If you're
currently in a same-sex relationship, please
let us
know if you've formalized your relationship through domestic partner
registration (i.e., government-issued, not employer-based), a civil
union, or by obtaining a marriage license.
Thank you, and - congratulations!
